General Constitution Petition
Pursuant to Article X of the Constitution and Bylaws of the Three Affiliated Tribes, The proposed Constitutional Amendments are as follows: The following Constitutional Amendment shall supersede Article III, Section 1: ARTICLE III – GOVERNING BODY Section 1. The governing body of the Mandan, Hidatsa and Arikara Nation shall be a General Council, composed of all persons qualified to vote in Tribal Elections. The General Council will elect its officers consisting of Chairman, Vice-Chairman, Secretary and Treasurer. These officers shall hold office for four (4) years or until their successors are duly installed. There shall be a Tribal Business Council consisting of the Chairman and six segment representatives that shall perform such duties as may be authorized by the General Council. Members of the Tribal Business Council shall hold office for four (4) years or until their successors are duly installed. They shall also act as officers. The governing body shall determine its own procedures. The following Constitutional Amendment shall supplement Article IV. ARTICLE IV – ELECTIONS All elections of officers, including the first election, shall be conducted under rules and regulations prescribed by the General Council. Tribal members eighteen (18) years of age or over shall qualify as voters and, if elected, may hold office. The following Constitutional Amendment shall supersede Article VI, Sections 1 and 5. ARTICLE VI – POWERS The General Council shall have such applicable powers as may be authorized by the Indian Reorganization Act of June 18, 1934 (48 Stat. 984), and other Acts of Congress. The General Council may delegate such powers to the elected Tribal Business Council, otherwise the TBC implements the policies and instructions of the General Council. The General Council shall manage the overall Tribal Monies and overall budget. Further powers may be delegated by the Secretary of the Interior or by duly authorized officials or agencies of government and such other powers as may have been customary and sanctioned before the adoption of this constitution. The exercise of all powers shall be subject to approval by the Secretary of the Interior, where required by Federal law or published regulations of the Secretary of the Interior. The General Council shall meet four (4) times per year and Special Meetings can be called by the General Council Chairman or majority of four officers. An established Quorum of the General Council shall be 10% of the eligible voting members of the Tribe and no business shall be transacted unless a quorum is present. The following Constitutional Amendment supplements Article VI: Section 3 (b) ARTICLE VI – BILL OF RIGHTS All members of the Tribe shall be accorded equal opportunities to participate in the economic resources and activities of the Tribe. All members of the Tribe may enjoy, without hindrance, freedom of speech, conscience, press, assembly, association, and due process of law, as guaranteed by the Constitutions of the Mandan, Hidatsa and Arikara Nation and of the United States
